Rider Contest Terms & Conditions

How to Enter

To enter the “Rider” contest, participants must:

1. Play the Riderball game on: https://www.newsfeedsmartapp.com/PumaRider
2. Submit their best time when prompted at the end of the game
3. Share a screenshot of their best time on Instagram (story or post) with the following tags:
   1. Tag @pumaindia
   2. Use #PUMARider
4. Follow @pumaindia on Instagram

Contest Duration

The contest shall be valid from 4 th March to 23 rd March 2020. Winners will be announced on or after 23 rd March on @pumaindia Instagram channel. Puma Sports India Pvt. Ltd (hereinafter referred to as “Organizer/Puma”) may in its absolute and sole discretion curtail or extend the Contest Duration as it deems necessary without any liability whatsoever.

Eligibility

1. The contest is available specifically for residents of India
2. The participant must be over 18 years of age
3. The participant must have a valid and existing Instagram account
4. The participant must follow the steps as appended above under the heading “How to Enter”
5. This contest is not applicable to the employees, affiliates and next of kin and/or any person associated with Organizer (in any manner) and they shall be excluded from this contest at all times
6. The participation in the contest is purely voluntary and by participating in the said contest, the participant accepts the terms and conditions of the contest unconditionally and fully
7. The participants must have a valid residential address, contact number, e-mail id along with appropriate identification proof.

Gratification

Participants stand a chance to win up to 5 pairs of PUMA Rider sneakers. Details are provided in clause 7 below, under “General Terms & Conditions; Disclaimers”

General Terms & Conditions; Disclaimers:

1. This contest is being organized by Puma Sports India Pvt. Ltd (“Organizer/Puma”) and shall also include their affiliates, subsidiaries and successors for all the purposes in relation to the contest
2. Puma reserve its right to replace the winner if the winner is disqualified or fails to fulfil the requirements of the contest and/or fail to acknowledge the prize within one week of declaration thereof
3. The participant may enter the contest through Instagram either once or multiple times; however, the same shall in no manner facilitate the chances of increasing the probability of winning the contest
4. The participant shall in no manner un-tag/un-follow Puma India social media handles and/or remove, delete the hashtags used during the Contest Duration. In such an event, the participant shall be not eligible for the contest and the winner shall not qualify for the prize and participants authorizes Puma to do so.
5. PUMA shall announce winners on Instagram. Participants will be adjudged on:
   • Shortest time taken to successfully finish Riderball
   • Upload on Instagram according to rules of the contest mentioned under “How To Enter”
   • Qualitative factors including but not limited to authenticity of the post or story

   PUMA will announce 5 winners who will each win a pair of Rider sneakers.

   The ruling of the jury panel of the Organizer PUMA and the procedure adopted by them shall be final and binding upon all the participants and no appeal or correspondence shall be entertained in this regard criteria. Puma shall endeavor to announce the winners on 23 rd March 2020, on @pumaindia Instagram handle; however, may in its sole discretion postpone the date of such results. Participants who fail to follow the rules of the contest, have any criminal record, fails to comply with any applicable laws, makes any offensive posts including but not limited to:

   1. It is strictly prohibited to upload content (picture/text/any other content) of any kind that contain expressions of hate, abuse, offensive images or conduct, obscenity, pornography, is sexually explicit or against any religious sentiments or against any caste, creed or race or any material, which is offensive to women or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with these Terms and Conditions or the Advertising Code of the Advertising Standards Council of India. It is also clarified that any entry which, in the reasonable opinion of the Organizer, is obscene, offending or hurtful shall be rejected immediately; and appropriate action will be taken against the said Participant. Entries will be rejected/deleted and will not be deemed valid entries for the purposes of this Contest if they:
      1. contain or display any commercial/corporate advertising other than that of Puma (including but not limited to corporate logos, brand names, trademarks, slogans, political, personal and religious statements);
      2. reference persons or organizations without their written permission;
      3. disparage any persons or organizations;
      4. are unlawful, in violation of or contrary to any applicable laws and/or regulations.
      5. represent a danger to health and safety or causes fear or distress; or are otherwise offensive or in bad taste.
      6. is in any way be obscene, vulgar, disrespectful or defamatory in any manner
6. Only such submissions of participants meeting the criteria as mentioned above, and are otherwise compliant with these terms and conditions, shall qualify for the Contest and shall hereinafter be referred to as ‘Valid Entries’ or ‘Valid Entry’. The decision of Puma with regard to validity of the entries shall be final and the Puma shall not entertain any claim or communication with respect to that entry by the participant.
7. The 5 (five) winners shall get a pair of PUMA Rider each. Exact sneaker delivered to the winner depends on availability of sizes and colorways. If the winner’s desired sneaker is not available in the required size, PUMA will endeavor to offer any other PUMA sneaker of the winner’s choice, of the same MRP value as Rider. The pictures of prizes depicted on the press ads/posters/ TVC’s, packs etc. are only representative and the actual prizes may vary from the depictions.
8. The winners may be contacted by the representatives of Puma on the contact number/email id/Instagram account shared by him/her on the direct message inbox. Each winner would be contacted once over a period of 48 (forty-eight) hours. In case, the winner is not reachable, or he/she cannot redeem the Prize for any reason whatsoever, Puma reserve the right to either forfeit the Prize or pass on the Prize to another Participant, selected as per Clauses listed above, without any further notice to the winner who could not be contacted.
9. By participating in the Contest, the participants hereby agree to all the terms and conditions stated above and authorize Puma to use in any manner whatsoever their photographs, videos and images. The Participants further indemnify Puma against any claim/loss accrued due to the authorized use of their images, videos, information and/or photographs. Winner, in the sole discretion of Puma, shall sign and return an affidavit of eligibility and a liability release and other terms and conditions within seven (7) days of the issuance of such documents or the prize may be forfeited and awarded to an alternate winner.
10. In case the participant is found using external random software that entail fake re-posting tools, he will be disqualified from the Contest. Puma has all rights to verify the credibility of the post and to forfeit the Prize in case the Participant is found to be using such tools/software to increase the number of shares/likes. The decision of Puma shall be final, and the participants shall accept the decision as a binding one and shall in no event contest the same. Subject to other terms and conditions contained herein, the participation shall be deemed to be made by the person who is the authorized holder of the Instagram account used to enter the Contest. In case a person uses the Instagram login credentials of another person and uses such account to participate in the Contest, then Puma would be within its rights to deny any claim of both such persons, i.e. the one who used the login credentials of another person as well as such other person.
11. All the prizes in the contest are non-transferable and cannot be licensed or assigned to any other individual and/or cannot be claimed/enjoyed/sought by anyone else other than the winners of the contest. Further, the prize cannot be substituted for any cash payment or barter of any kind. The selection of the winners of the Contest will be aggregated at the end of the Contest Duration. The winners will be notified as per Clause 5 and winners will be required to share a valid proof of identity and age in the form of a copy of PAN Card / Driving License / Voter ID / Indian passport. A PAN card copy is mandatory for prizes worth INR 10, 000/- (Rupees Ten Thousand Only) or more. The prize shall be considered as forfeited if the winner does not meet the eligibility criteria or does not comply with these T&Cs. Each Prize will be awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). There are no cash or other prize alternatives available in whole or in part. If the winner does not respond back to any communications sent in relation to the Contest within the time period communicated, he/she shall not be eligible to be declared winner of the Prize. Puma's decision on the winner shall be considered as final. All the Puma merchandise/products provided to the winners shall be governed by the standard warranties.
12. By participating in the Contest, the Participants hereby agree to make themselves available for any promotional and/or marketing purposes and/or any publicity purposes. The participants further authorize Puma to publish including but not limited to the images, videos, quotes of the participants in any manner whatsoever in both online and offline media channels.
13. By entering in the Contest, the Participants hereby authorize Puma to use their personal information including but not limited to names, photographs and/or any such personal data for any marketing or promotional campaigns. Such use of the data by Puma shall in no case be termed as invasion of privacy and personal rights and the participants further indemnify Puma from all such claims and/or loss. By entering the Contest, the participant consent to being placed on a mailing list for promotional and other materials for PUMA. The participant may update or change their email preferences at the email preferences page.
14. Participation in this contest shall be limited to this contest only and in no manner shall entitle the participant to be eligible for any other contest that may be initiated by Puma in the future. Further, the participants shall comply/abide with the rules/instructions given by Puma and any non- adherence to the same shall result in disqualification. Any lack of cooperation shall entitle the Organizer to forfeit the Prize in its entirety or pass on the Prize to another Participant. Organizer shall not be liable for any loss or non-receipt of Prize due to incorrect details or the failure of any winner to take the delivery, for any reason whatsoever. The Organizer will not be liable for any failure to provide the Prize due to technical issues or any other logistical issues
15. In the event of any inconsistency between these terms and conditions and any advertising, promotional, publicity and other materials relating to or in connection with this promotion, these terms and conditions shall prevail
16. Puma has no control over and is not responsible if for any reason/s whatsoever, if the said prize/s cannot be availed/redeemed for any reason whatsoever and in no event shall be liable for any losses or any incidental or consequential damages whatsoever caused to the winner/s due to the same
17. By participating into this Contest, the Participant(s) agree that Puma shall not be liable for injury, loss, or damage of any kind resulting from participating in this Contest or from the acceptance or use/misuse of the prize/s awarded. This includes, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. By participating in this Contest, the participant and/or their legal guardians (wherever applicable) accept all risk and consequences of entry and participation in this Contest, and agree to release and hold Puma its officers, directors, affiliates, employees, contractors, subsidiaries, agents and partners harmless from any and all consequences, liability, losses, damages (including without limitation, consequential, punitive, incidental, special or increased damages and those related to personal injury, death or damage to property) and costs and expenses, of any kind, under any legal theory, arising from or related to this Contest, including but limited to the entry and participation in this Contest, the acceptance and/or use (or misuse) of any prize, printing errors, any claims based upon rights of publicity and invasion of privacy. The participant shall indemnify Puma, its officers, directors, affiliates, contractors, subsidiaries, agents, employees and partners from and against all claims or suits and any damages or costs (including reasonable attorneys’ fees) arising from or relating to participant’s violation or inaccuracy of any warrantees or representations made relating to this Contest. Puma assumes no responsibility for errors which may occur in the transmission of entrant’s entry. Puma is not responsible for any fraud or misconduct on the part of the participants. Should a participant engage in fraud or misconduct of any nature, including but not limited to a violation of the Official Contest Rules, such participant shall be subject to immediate disqualification. Puma reserves the right to terminate, modify or amend the Contest at any time if the fairness, integrity, and or proper administration of the Contest is jeopardized. IN NO EVENT, SHALL PUMA BE LIABLE TO PARTICIPANT FOR ANY LOST PROFITS, OR FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER INDIRECT DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS CONTEST. Participant’s sole damages shall be limited to participant’s actual out of pocket expenses, excluding attorneys’ fees. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND CONTEST ENTITIES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSES AND/OR NON-INFRINGEMENT.
18. PUMA accepts no responsibility for late, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected participant entries submitted by email/Facebook/Twitter/Instagram/Tik- Tok or any similar means, whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. To the fullest extent permitted by law, Puma hereby excludes all warranties, representations, covenants and liability (whether express or implied) regarding the Contest. The user shall be solely responsible/liable to comply and abide by the rules, regulations, policies and obligations as mandated by any social media channel including nstagram
19. None of the provisions of these terms and conditions shall be deemed to constitute a partnership or agency between Puma and participant and participant shall have no authority to bind Puma in any manner whatsoever
20. All rights, title and interest including but not limited to the Intellectual Property Rights in the promotional material(s) and any/all registrations received shall vest solely and exclusively with Puma at all times and Puma or any other of the Puma Group Companies, affiliates shall be entitled to use the articles, database, material of the entries received or any information in any media for future promotional, marketing and publicity purpose without any further reference or payment or compensation to you as a participant
21. Participants shall be solely responsible for any consequences which may arise due to any kind of infringement of copyrights or any kind of intellectual property rights belonging to any other person/ entity etc. and also undertake to indemnify Puma and its officers, directors, employees, etc. on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis
22. Puma has no control over communications networks or lines and does not accept any responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. Puma is not liable for any consequences of user error including (without limitation) costs incurred. Puma reserves the right, in their sole discretion, to disqualify any individual found to be tampering with the participation process or the operation of the said Contest
23. Each participant agrees that he/she has read and understood these terms and by their participation in the contest, each participant agrees to be bound by the terms. Mere participation should not be perceived as any commitment on the part of Puma to select a participant as the winner. Nothing herein amounts to a commitment by Puma to conduct further, similar or other contests in future
24. PUMA reserves its rights to cancel, amend, suspend, withdraw, and/or reset the contest and the terms and conditions at any time without any prior notice
25. The participation in the Contest as per the designated format will constitute the acceptance of these Terms and Conditions. Such acceptance by the Participants shall be without any limitation
26. The Participant(s) hereby consent to the exclusive jurisdiction and venue of courts in Bangalore, India in all disputes arising out of or relating to the Contest or any of the Terms and Conditions set out therein
27. This Contest is subjected to applicable laws, Force Majeure events and Puma shall not be held liable for any act or omission of act due to such Force Majeure Events and/or any act or omission of acts owing to the compliance of applicable laws
